Please read this carefully. This is a legal agreement between you, the end user, and North Suburban Trading Corporation. BY INSTALLING THE SOFTWARE ON A COMPUTER, YOU ARE AGREEING TO BE BOUND BY THE TERMS OF THIS AGREEMENT.

1. GRANT OF LICENSE. North Suburban Trading Corporation grants you the non-exclusive license to install and use the software for the duration of the evaluation period. You are licensed to make as many copies of the NSTC Position Analyzer evaluation version as you wish and distribute it to anyone provided that all files are intact. You must distribute the install form of the NSTC Position Analyzer evaluation version (you must distribute the INSTALL file, not the files resulting of an installation). You are not allowed to sell the NSTC Position Analyzer evaluation version.

2. OWNERSHIP AND COPYRIGHT. The Software was developed by North Suburban Trading Corporation. The Software is protected by the United States copyright laws and international treaty provisions as well as other intellectual property laws and treaties. All title and copyrights in and to the Software and the accompanying printed materials are owned by North Suburban Trading Corporation. You acquire only a non-exclusive license to use the Software subject to this Agreement. You agree not to duplicate the Software, except that you may either: a) make a copy of the Software solely for backup or archival purposes, or b) transfer the Software to a single hard disk, provided that you keep the original solely for backup or archival purposes. You may not directly or indirectly offer or transmit all or any portion of the Software to the third parties whether by way of subscription, license, sale or otherwise. You may not copy the written material accompanying the Software or remove any proprietary notices or labels on the Software. You may not modify, translate, reverse engineer, de-compile, or disassemble the Software or the Data.

3. NO LIABILITY FOR CONSEQUENTIAL DAMAGES. IN NO EVENT SHALL NORTH SUBURBAN TRADING CORPORATION BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF BUSINESS INFORMATION, BUSINESS INTERRUPTION OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OR INABILITY TO USE THE SOFTWARE OR THE DATA, EVEN IF NORTH SUBURBAN TRADING CORPORATION HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGE. SOME STATES DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR INCIDENTAL OR CONSEQUENTIAL DAMAGES SO THE ABOVE LIMITATION MAY NOT APPLY TO YOU.

4. NO WARRANTY ON DATA. The Software uses data provided by Yahoo and TD Ameritrade. The data is believed to be reliable, complete, accurate and timely. However, North Suburban Trading Corporation does not represent, warrant, or guarantee such completeness, accuracy or timeliness, and shall have no liability of any kind on account of any incompleteness of, inaccuracies in or untimeliness of the data, or for any delay in reporting such data. With regard to the subject matter of this Paragraph 4, in no event shall North Suburban Trading Corporation have any liability of any kind for any damages even if notified of the possibility of such damages.

5. MISCELLANEOUS. North Suburban Trading Corporation support services and product pricing are subject to North Suburban Trading Corporation's then-current prices, terms and conditions, which are subject to change without notice.

6. THINKORSWIM (TOS). In addition to Yahoo data, the software can interface with TD Ameritrade thinkorswim (TOS) trading platform. North Suburban Trading Corporation neither licenses nor distributes TOS. IN NO EVENT SHALL NORTH SUBURBAN TRADING CORPORATION BE LIABLE FOR ANY SPECIAL, INCIDENTAL, OR CONSEQUENTIAL DAMAGES WHATSOEVER, (INCLUDING WITHOUT LIMITATION, DAMAGES FOR LOSS OF PROFITS, LOSS OF BUSINESS INFORMATION, BUSINESS INTERRUPTION OR OTHER PECUNIARY LOSS) ARISING OUT OF THE USE OF DATA PROVEDED BY TD AMERITRADE.
